This general terms and conditions of Sale and Services are those of Maison Sunberg.
The purchase of any Products offered on this website MaisonSunberg (hereinafter referred to as the “Site”) is subject to these terms and conditions for the Site.
We advise you to carefully read the following Terms & Conditions (clauses 1 through to 22), before accessing or using any part of this Site. By accessing or using this Site, you agree to all Terms & Conditions which apply to all users of the site, including but not limited to users who are browsers of the site, customers, or contributors of content (hereinafter to be referred to as “User”).
The Use shall also confirm he/she/it is an end consumer and does not intend to resell the Maison Sunberg Products for commercial purposes.
Maison Sunberg is entitled to revise these Terms & Conditions at any time, by updating the ‘Terms & Conditions’ section of the Site. The revised terms and conditions would take effect at the date when they are posted on the Site, and their terms and conditions applicable at the time of entering into the eventual sale contract are those which are binding on the User.
- Terms of Use of Maison Sunberg Website:
The Site and all of its contents are owned and copyrighted by Maison Sunberg with all rights reserved. Any content that is a trademark, logo, or service mark, is also a registered trademark of Maison Sunberg. Usage of any content except as provided in these Terms & Conditions, without written permission of Maison Sunberg, is strictly prohibited.
Maison Sunberg products may not be used for any illegal or unauthorized purpose nor may, in the use of the Site, should any law of the User’s/Users’ jurisdiction be violated (including but not limited to Intellectual Property Rights laws).
The User may not transfer any worms, or viruses or any code of a destructive nature for phishing, hacking, or any other illegal activity, via any correspondence and/or by any means.
Maison Sunberg reserves the right to seek legal recourse including but not limited to criminal prosecution against anyone violating the above stated Terms and Conditions.
The User agrees to provide current, complete and accurate purchase and account information for all purchases made at the Site. User agrees to promptly update his/her/its account and other information, including any associated email addresses and credit card numbers and expiration dates, so that the transactions can be completed and User be contacted as needed.
- Products & Services
Items offered (hereinafter referred to as “Products”) are those listed on the Site on the web link: MaisonSunberg through the Site (hereinafter referred to as Catalogue) and are available within the stock limits.
The Products offers and prices are valid as long as they remain visible on the Site. Maison Sunberg shall not liable if Products are out of stocks or unavailable for orders that have not yet been accepted by Maison Sunberg.
As part of the selling process, and to facilitate the Users, Maison Sunberg provides the service of receiving orders, after they are placed and paid for by the User, processing orders, packing the products, and dispatching the products to the shipping address provided by the Users. In addition, Maison Sunberg also provides pre-sales and after-sales service to the Users, in the form of addressing the User’s queries which may be received, both before and after the sales. These range of services, may hereinafter be referred to as the “Service”.
Certain products or services may be exclusively available online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to Maison Sunberg’s Return Policy which can be viewed on Return Policy.
Maison Sunberg has made every effort to display as accurately as possible, the colours and images of the Products. Image display may vary from one equipment to another. Maison Sunberg cannot guarantee that a computer monitor’s display of any colour will be accurate.
- Amendments to the Products, Service, Site and Prices
Maison Sunberg reserves the right to amend any Product or Service without any notice or reason.
The prices listed on the Catalogue, are priced in euros taking into account the VAT applicable on the date of the order; any rate change will be reflected in the price of items.
Maison Sunberg reserves the right to modify its prices at any time, provided that the price listed on the Site on the day of the order shall be solely applicable to the User. Prices do not include the cost of shipping.
Maison Sunberg shall not be liable to any one directly or to any third-party for any modification, price change, suspension or discontinuance of the Service.
- Right to provide Products and Services
Maison Sunberg reserves the right to limit the sales of Products or provision of Services to any geographic region or jurisdiction. Maison Sunbergs reserves the right to limit the sales of Product to any person, but only with the respect of the article L.121-11 of the French Consumer Code.
Maison Sunberg may exercise this right on a case-by-case basis. Maison Sunberg reserves the right to limit the quantities of any products or services that it offers.
All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of Maison Sunberg.
Maison Sunberg reserves the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
- Quality
Maison Sunberg does not warrant that the quality of any products, services, information, or other material purchased or obtained, will meet expectations, or that any errors in the Service will be corrected.
Maison Sunberg also does not make any conditions or warranty that the Products would be suitable or fit for any particular purpose unless otherwise provided by way of information along with the Product.
- Accuracy of Billing and Account Information
The User would provide accurate billing and account information. Failure or incorrect information would not in any way make Maison Sunberg responsible legally for any repercussion as a result of the same.
- Modification or Cancellation of Orders and Services
Maison Sunberg reserves the right to refuse, modify or discontinue to Service (or any part of it thereof) temporarily or permanently, without notice at any time for any reason. Any exercise of such a right by Maison Sunberg would trigger the applicability of specific terms of the Limitation of Liability clause.
Maison Sunberg reserves the right to refuse, limit or cancel any order that is placed, if notably the Products ordered are no more available or that the User appears to be a dealer, reseller or distributor.
These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that Maison Sunberg makes a change to or cancel an order, it may attempt to notify the purchaser by contacting the e-mail and/or billing address/phone number provided at the time the order was made. Maison Sunberg reserves the right to limit or prohibit orders that, in its sole judgment, appear to be placed by dealers, resellers or distributors.
- Orders and Shipping Policies
The User may add Products to “cart” by clicking on “add to cart”, and choose to “checkout” to finalize its order or to continue shopping.
Maison Sunberg retains ownership of the items until full payment of the order, that is to say, until the receipt of the order price by Maison Sunberg.
- Payment Policy
Maison Sunberg accepts payment via Credit Card and PayPal. The payment shall be made as your card is charged for orders at the time you enter your Shipping and Billing information and complete your check out. After payment, you shall receive confirmation via e-mail.
- Return Policy
Maison Sunberg offers a 14-day conditional return policy to its valued customers.
Products can be returned for exchange or customers can be refunded within 14 days of delivery date.
Products may be returned due to:
- The product arrived in damaged condition.
- Wrong product been shipped.
- The product in question is no longer desired.
All returns must comply with following:
- Maison Sunberg must duly be notified about the desire to either return the product for exchange, or a refund within fourteen (14) days following its order.
- Returned products must be unused, in perfect condition, undamaged, in the original packaging.
- Maison Sunberg will not accept any returns that have been used or are soiled.
- Proof of posting is retained for reference. In the absence of such proof, no exchange or refund will be made in case of loss of the parcel.
In the event of a wrong product being delivered to the customer, we would be glad to bear all costs of shipping for the customer. We therefore advise our customers review their orders thoroughly before placing it.
To begin process for return, customers shall be required to write to us on order@maisonsunberg.com informing us of the reason and fill in a Withdrawal Form
In case of delivery error or non-compliance with the information contained in the confirmation of order, please contact Maison Sunberg within 48 hours of receipt. In this case, Maison Sunberg supports the return and replacement of the package.
Customers shall be refunded as soon as possible and no later than 14 days after the date on which he exercised his right of withdrawal.
- Third-Party Tools
Maison Sunberg may provide user with access to third-party tools on the Site over which Maison Sunberg neither monitors nor has any control.
You acknowledge and agree that Maison Sunberg provides access to such tools on ‘as is’ and ‘as available’ basis, without any warranties, representations or conditions of any kind and without any endorsement. Maison Sunberg shall have no liability whatsoever arising from or relating to use of optional third-party tools by any User.
Any use of optional tools offered through the Site is entirely at User’s own risk and discretion and users should ensure that they are familiar with, and approve of the terms on which tools are provided by the relevant third-party provider(s).
Maison Sunberg may also, in future, offer new services and/or features through the Site (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms & Conditions.

Certain content, products and services available via the Site may include materials from third-parties.
Third-party links on this Site may direct users to third-party websites that are not affiliated with Maison Sunberg. Maison Sunberg is not responsible for examining or evaluating the content or accuracy and Maison Sunberg does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
Maison Sunberg is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. The third-party’s policies and practice may be reviewed carefully to ensure they are understood before the third-party website is engaged in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
- User Comments, Feedback and Other Submissions
If, at Maison Sunberg’s request, certain specific submissions (for example contest entries) are sent, or without a request from Maison Sunberg, creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘Comments’) are sent, Maison Sunberg may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise, use in any medium any comments that are forwarded. Maison Sunberg shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
Maison Sunberg may, but have no obligation to, monitor, edit or remove content that it determines in its sole discretion, are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms & Conditions.
Any one providing Comments agrees that the Comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. It is further agreed that the Comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site or any related service. A false e-mail address, pretending to be someone other than the sender, is not to be used, nor otherwise to mislead Maison Sunberg or third-parties as to the origin of any Comments. Senders of such comments are solely responsible for any comments made and their accuracy. - Personal Information
Each User of the Site undertakes to consent to the collection, the use and the disclosure of its information, including personal and financial information by Maison Sunberg. Any person disagreeing with this terms and conditions or any modification thereto shall exit the Site and do not purchase any of the Products or Services offered on the Site.
However the User can use the Site without providing any personal information, if he/she does not create a customer account, but he/she shall agree that Maison Sunberg has the right to collect non-personal information even if the User do not have created a customer account.
The User undertakes that its personal information he/she submitted are collected by Maison Sunberg and stored 10 years at most.
Maison Sunberg may share the User’s personal data to third parties in order to deliver the Products, or to execute the Services to the Users who requested it, or to combat attempts at fraudulent online payment or for any criminal behaviour.
Any User can request to Maison Sunberg the deletion of its own personal information any time as soon as the order has been delivered by sending an email to contact@maisonsunberg.com.
Maison Sunberg may also share the personal information of the Users if such disclosure is necessary regarding the applicable laws.
- Errors, Inaccuracies and Omissions
Occasionally there may be information on the Site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Maison Sunberg reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after an order has already been submitted).
Maison Sunberg undertakes no obligation to update, amend or clarify information on the Site or on any related website, including but not limited to pricing information, except as required by law. No specified update or refresh date applied on the Site or on any related website, should be taken to indicate that all information on the Site or on any related website has been modified or updated.
- Limitation of Liability
Maison Sunberg would not in any event be held liable for any actions brought in respect of use of the Site by any User.
- Indemnity
The User agrees that he/she/it will indemnify and hold harmless Maison Sunberg and its representative officers, agents, directors, managers and employees from any liabilities, causes of action, lawsuits, penalties, damages, claims or demands (including the costs and expenses and reasonable attorneys’ fees on account thereof) that may be made by a third party for damages of any kind or nature arising out of and relating to:

(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

- Computing and Freedoms
The data requested are necessary for the client order processing and invoicing. The same would be shared with third parties to the extent necessary for processing and delivering the Products.
These data may also be used for internal statistical purposes and will in no case be disclosed outside the company unless the same are required to be disclosed by way of law.
- Applicable Law
These Terms are governed by and subject to French law.
